Opera Ballet Vlaanderen vzw values your privacy as a customer and processes your personal data in accordance with the following privacy policy.

Our audience comes first, and as the largest cultural institution in Flanders, we strive to provide you, our customers, with high-quality service tailored to your interests and needs.

Opera Ballet Vlaanderen vzw, with its registered office at Van Ertbornstraat 8, 2018 Antwerp, is the controller of your personal data under the applicable GDPR legislation (also known as the General Data Protection Regulation).

By purchasing tickets and using our services (including our websites), you agree to this privacy policy.

2. DEFINITIONS

The following terms shall mean:

  • Data Subject: an identified or identifiable natural person;

  • Personal Data: any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

  • Processing: any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment, combination, restriction, erasure or destruction;

  • Purpose(s): the purposes for which the personal data are processed, as set out in this privacy policy;

  • Recipient: a natural or legal person, public authority, agency or another body, to whom the personal data are disclosed, whether a third party or not;

  • Third Party: a natural or legal person, public authority, agency or body other than the data subject, controller, processor, and persons who, under the direct authority of the controller or processor, are authorized to process the personal data.

3. SCOPE

To provide clarity and transparency about how we handle your personal data, we have drafted this privacy policy. Here we explain when and what personal data is processed, and for what purposes. This privacy policy applies to the services of Opera Ballet Vlaanderen vzw, and more specifically to the Karmaseats.

4. EXTENT OF THIS PRIVACY POLICY

Collection of personal data by OBV:

  • when you subscribe to the last-minute list on our website;

  • when you subscribe to the monthly Opera Ballet Vlaanderen newsletter;

  • when you otherwise use our services and products.

Legal basis:
Each processing of personal data must be based on one of the legal grounds (Art. 6.1). Opera Ballet Vlaanderen vzw mainly relies on:

  • Consent: Opera Ballet Vlaanderen vzw may process your personal data if we have obtained your consent. Each consent must be freely given, specific, informed, demonstrable, and based on a positive action. Sensitive data may only be processed with explicit consent. Furthermore, any consent must always be as easy to withdraw as it was to give.

  • Contract: we use your personal data only in the context of performing a contract or taking pre-contractual measures. However, this legal basis does not apply to the processing of sensitive data.

  • Vital interest: data processing is necessary to protect the vital interests of the data subject or another natural person. This ground applies only in cases where there is a risk to the health and/or life of a natural person.

  • Public task: the personal data are needed to perform a task in the public interest or a task assigned to the organization in the exercise of official authority.

  • Legitimate interest: we process your personal data for reasons that concern the legitimate interests of Opera Ballet Vlaanderen, for example, to detect invoice fraud and inform our customers of it. When carrying out this type of processing, we strive to balance this legitimate interest with respect for your privacy.

Types of personal data:
For the Last Minute list, the following personal data may be collected and stored:

  • First and last name

  • Date of birth

  • Email address

  • Preferred locations

  • Other personal data you actively provide, for example by creating a profile on our website, in correspondence, or by telephone.

Purposes:

  • the functioning of the website;

  • marketing purposes;

  • to send our monthly newsletter and for related processing and follow-up.

After your registration on our website, we may also request additional information that could help us provide even more tailored services.

Data retention:
The personal data are stored in strictly secured data centers, but not longer than necessary to achieve the purpose for which we originally collected them. The suppliers of the databases can under no circumstances use the personal data. Opera Ballet Vlaanderen vzw retains the personal data until you request their deletion.

We store your data for direct marketing for 3 years or until you withdraw your consent.

Your personal data will not be transferred, sold, or exchanged by Opera Ballet Vlaanderen vzw for marketing purposes.

If you are no longer an active customer of Opera Ballet Vlaanderen vzw, we will no longer use your data for promotional mailings. Opera Ballet Vlaanderen vzw may occasionally use your data (location, age) for statistical purposes.

5. SECURITY MEASURES

Opera Ballet Vlaanderen vzw ensures appropriate technical security for your personal data and makes sure that the data are only accessible to a limited number of employees who need them for the performance of their duties.

6. TRANSFER TO THIRD PARTIES

We will not transfer your data to third parties without your explicit consent, unless this is necessary to achieve the purposes described in this privacy policy or due to legal obligations.

7. WHAT ARE YOUR RIGHTS AND HOW CAN YOU EXERCISE THEM?

We will process your personal data only in a transparent and lawful manner, for the explicit and legitimate purposes mentioned above. We ensure that the processed personal data are adequate, accurate, relevant, and not excessive. In addition, as a data subject, you have several rights relating to the personal data you have shared with us.

  • Right of access (Art. 15): You have the right to know whether your personal data are being processed. You can always request a copy (in a structured, commonly used, and machine-readable format) of your personal data.

  • Right to rectification (Art. 16): You always have the right to correct your personal data if they are incorrect or incomplete.

  • Right to restriction of processing (Art. 18): In certain circumstances, you may request Opera Ballet Vlaanderen vzw to temporarily stop processing your personal data. You may exercise this right if:

    • the data are not accurate,

    • the processing is unlawful and you oppose erasure, requesting restriction instead,

    • the controller no longer needs the personal data for processing purposes,

    • you have objected to the processing of your personal data pending the outcome of the balancing test between the organization’s grounds and yours.

  • Right to object (Art. 21): You may object to the processing of your personal data (based on Article 6.1 (e) or (f)), including profiling based on those provisions.

  • Right not to be subject to automated decision-making, including direct marketing and profiling (Art. 22): You have the right to object to direct marketing and the profiling associated with it.

Opera Ballet Vlaanderen vzw may amend or update this privacy policy. The date and version number are always shown at the bottom of this page. Changes take effect automatically upon publication.
